Terms of Service

These terms outline the important things you need to know about accessing and using the ProtectYourLicense.com ("we," "our," "us," or "Company") website, web application, and services (collectively, "Services"). These Terms of Service ('Agreement," "Terms of Service," or "Terms") apply to any use of and access to our Services by individuals and/or entities (collectively, "you" or "your").

Agreement

Account Creation

If you discover or suspect any security breaches to your email account, or our Services, please let us know as soon as possible.

Course Purchases

In order to purchase Services, you must create a ProtectYourLicense.com account and agree to provide accurate and complete information at all times, including, but not limited to, your name, email address, telephone number, a valid credit card number or other account number, and the credit card expiration date.

We accept payments by VISA, MasterCard, Discover and American Express credit cards. By submitting your order, you acknowledge that you are authorized to use the designated credit card and you authorize ProtectYourLicense.com and it representatives to charge your order to that credit card. If the card cannot be verified, is invalid, or is not otherwise acceptable (e.g., insufficient funds) course access may be suspended, or your account deleted, automatically. Card processing fees may apply even if the card has expired or changed by the time ProtectYourLicense.com submits the charges.

All prices are shown in U.S. dollars. We have the right to change the prices at any time and new prices will become effective subject to the automatic renewal provision below.

You are responsible for any taxes that you are obligated to pay or that ProtectYourLicense.com may collect from you in connection with your purchase. If you do not pay the sales or other taxes or fees on a transaction, you will be responsible for the taxes or fees in the event they are later determined to be payable on the sale, and ProtectYourLicense.com reserves the right to collect the taxes or other fees from you at any time.

We put a lot of effort into creating the Services including, the logo and all designs, text, graphics, pictures, information, workflows, and other content (excluding your content). This property is owned by us and it is protected by U.S. and international copyright laws. We grant you the right to use the Services, but do not attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, or translate the Services.

However, unless we expressly state otherwise your rights do not include: (i) publicly performing or publicly displaying the Services, (ii) modifying or otherwise making any derivative uses of the Services or any portion thereof; (iii) using any data mining, robots or similar data gathering or extraction methods; (iv) downloading (other than page caching) of any portion of the Services or any information contained therein; (v) reverse engineering or accessing the Services in order to build a competitive product or service; or (vi) using the Services other than for its intended purposes. You may create a hyperlink to our Services. But, you may not use, frame or utilize framing techniques to enclose any ProtectYourLicense.com trademark, logo or other proprietary information without our express written consent.

OUR SERVICES ARE NOT INTENDED TO SERVE AS A SUBSTITUTE FOR OBTAINING THE SERVICES OF AN ATTORNEY OR OTHER PROFESSIONAL.

ALL DISCLAIMERS OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THIS AGREEMENT) ARE MADE ON BEHALF OF BOTH THE COMPANY AND ITS AFFILIATES AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, REPRESENTATIVES, CONTRACTORS, LICENSORS, SUPPLIERS AND SERVICE PROVIDERS (COLLECTIVELY, THE “COMPANY PARTIES”).

Indemnification

You agree to defend, indemnify and hold us harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys' fees, costs, penalties, interest and disbursements) we incur in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party relating to your use of the Services, the use of the Services by any person using your account or the use of the Services by any person you made part of your team through the Services, including any claim that your use of the Services violates any applicable law or regulation, or the rights of any third party, and/or your violation of these Terms.

You further agree to indemnify, defend, and hold harmless ProtectYourLicense.com, Christopher Greene, D.C., its subsidiaries, and affiliates from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs or expenses of whatever kind, including reasonable attorneys’ fees, arising from or in connection with your use of the Services in a manner inconsistent with these Terms of Service or with any user manuals, installation guides, instructions, and/or operating procedures given to you by us or any assertion that your use of the Services results in the infringement of patent, trade secret, trademark, copyright, or other intellectual property rights of third parties.

Your obligations under this Indemnification section shall survive and continue in full force and effect notwithstanding the expiration or termination of these Terms of Service, any agreement you have entered into with us, or any supplement thereto.

No Liability

THE COMPANY EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY AND WILL NOT BE RESPONSIBLE FOR ANY DAMAGES OR LOSS CAUSED, OR ALLEGED TO BE CAUSED, BY THE TRANSMISSION OF CARDHOLDER DATA PRIOR TO ITS ENCRYPTION AND RECEIPT BY SERVER(S) OWNED OR CONTROLLED BY THE COMPANY. THE EXCLUDED DAMAGES WILL INCLUDE, WITHOUT LIMITATION, DAMAGES RESULTING FROM FRAUD, EMBEZZLEMENT, THEFT, IDENTITY THEFT, OR INVASION OF PRIVACY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY PARTIES’ AGGREGATE LIABILITY, COLLECTIVELY, FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR OTHERWISE, EXCEED THE FEES PAID PRECEDING THE DATE OF THE INCIDENT. ALL LIMITATIONS OF LIABILITY OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THIS AGREEMENT) APPLY WITH RESPECT TO BOTH THE COMPANY AND THE COMPANY PARTIES.

IN NO EVENT WILL THE COMPANY HAVE ANY LIABILITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, HOWEVER CAUSED, OR FOR ANY LOST PROFITS, LOSS OF USE, DATA OR OPPORTUNITIES, COST OF DATA RECONSTRUCTION, COST OR PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THE SERVICES OR THIRD PARTY OFFERINGS, INCLUDING BUT NOT LIMITED TO THE USE OR INABILITY TO USE THE SERVICES, ANY INTERRUPTION, INACCURACY, ERROR OR OMISSION, EVEN IF THE COMPANY, ITS LICENSORS OR SUBCONTRACTORS HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES.

THE COMPANY EXPRESSLY DISCLAIMS ANY LIABILITY THAT MAY ARISE BETWEEN USERS RELATED TO OR ARISING FROM USE OF THE SERVICES. YOU HEREBY RELEASE AND FOREVER DISCHARGE THE COMPANY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES (ACTUAL OR CONSEQUENTIAL) OF EVERY KIND AND NATURE, WHETHER KNOWN OR UNKNOWN, CONTINGENT OR LIQUIDATED, ARISING FROM OR RELATED TO ANY DISPUTE OR INTERACTIONS WITH ANY OTHER USER, WHETHER ONLINE OR IN PERSON, WHETHER RELATED TO THE PROVISION OF SERVICES OR OTHERWISE.

THE FOREGOING EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

Governing Law

The validity of these Terms and the rights, obligations, and relations of the parties under these Terms will be construed and determined under and in accordance with the laws of the State of California, without regard to conflicts of law principles.

Jurisdiction & Waiver of Representative Actions

You expressly agree that exclusive jurisdiction for any dispute with ProtectYourLicense.com, or in any way relating to your use of the Services, resides in the courts of the State of California and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of California located in Orange County, California in connection with any such dispute including any claim involving Christopher Greene and ProtectYourLicense.com. You further agree that you and Christopher Greene and ProtectYourLicense.com will not commence against the other a class action, class arbitration or other representative action or proceeding.

Entire Agreement

These Terms constitute the entire agreement between you and ProtectYourLicense.com regarding the use of our Services, superseding any prior agreements.

Feedback & Product Reviews
